Scope of application


These general terms and conditions define the mutual rights and obligations in case of the purchase of CIL-LOU products on www.cil-lou.be by the customer.

The general terms and conditions express all the obligations of the parties. The customer is deemed to accept them without reservation, failing which his order will not be validated.

Exceptions to the provisions of the general terms and conditions can be made in exceptional cases, provided that these exceptions have been agreed in writing. Such deviations may consist of changes, additions or deletions of the provisions to which they relate and do not affect the application of the other provisions of the general terms and conditions.

CIL-LOU reserves the right to change the terms and conditions from time to time. The changes will apply as soon as they are posted online for any purchase after that date.

Online Store

Via www.cil-lou.be, CIL-LOU provides the customer with an online web shop that presents the products offered. The presentation of the products offered (e.g. via photos) has no contractual value.

The products are described and presented with the greatest possible accuracy. However, CIL-LOU cannot be held liable for errors or omissions in the presentation.

The products are offered within the limits of their availability.

Price


CIL-LOU reserves the right to change its prices at any time by publishing them online.

Only the prices indicated and the taxes in force at the time of the order are applicable, subject to availability on that date.

The prices are indicated in euros and do not take into account any delivery costs, which are also indicated and invoiced before the validation of the order by the customer.

The total amount of the order (including all taxes) and, if applicable, the delivery costs will be stated before the final validation of the order.

For B2B, we ask for an order with a minimum amount of € 150, excluding VAT, for the first purchase of our products. This is to ensure that our products are presented in a good way, with a nice choice of range for the end consumer.

Order online


The customer has the option to complete an order online using an electronic form. By completing the electronic form, the customer accepts the price and description of the products.

To validate his order, the customer must accept these general terms and conditions by clicking on the place indicated.

The customer must provide a valid email address, billing information and, if applicable, a valid delivery address. Any communication with CIL-LOU can take place via this email address. - info@cil-lou.be

In addition, the customer must choose the mode of delivery and validate the method of payment.

CIL-LOU reserves the right to block the customer's order in case of non-payment, incorrect address or any other problem on the part of the customer until the problem has been resolved.

Confirmation and payment of order


CIL-LOU remains the owner of the ordered products until full payment of the order has been received.

Payment


The customer makes the payment at the time of the final validation of the order using the chosen payment method. This validation is in lieu of a signature.

You can choose from the following payment options: Bank contact (also via the bank contact app), KBC/CBC Payment Button, Belfius Pay Button, Credit Card, Ideal (Netherlands), Sofort Banking.

We guarantee you a secure online payment via a secure SSL connection from payment provider Mollie. Paying online is not only very simple, you can also really rest assured that everything goes smoothly and correctly. Your payment details and all entered information will only be used for the payment of your relevant order. This data is processed 100% securely and is never released to other parties.

Your order will only be shipped once we have received payment.
If you have received an order confirmation in your mailbox, your payment has been successful.

If we have another agreement for an order, you can transfer the discussed amount to the account number that we provide you by e-mail.

The customer guarantees to CIL-LOU that he has the necessary authorizations to use this method of payment and acknowledges that the information provided for this purpose constitutes proof of his agreement to the sale and payment of the amounts due under the order.

In the event of refusal to authorize payment by credit card by accredited organizations or in the event of non-payment, CIL-LOU reserves the right to suspend or cancel the order and its delivery.

CIL-LOU also reserves the right to refuse the order of a customer who has not or only partially processed a previous order or who is in the process of a payment dispute.

Confirmation


After receiving the validation of the purchase with payment, CIL-LOU will send the purchase to the customer, as well as an invoice, unless the latter is delivered with the order.

The customer may request that the invoice be sent to an address other than the delivery address by sending a request to CIL-LOU before delivery.

In the event of unavailability of a product, CIL-LOU will inform the customer as soon as possible by email or by email to replace or cancel the order for this product and possibly refund the price in question, leaving the rest of the order fixed. and remains permanent.

Evidence


The communications, orders and payments between CIL-LOU and the customer can be evidenced by automated records, which are kept in CIL-LOU's computer systems under reasonable security conditions.

Delivery


Delivery will only take place after confirmation of payment by CIL-LOU's bank.

The products are delivered to the address indicated by the customer on the online order form. Additional costs resulting from incomplete or incorrect information from the customer will be charged to the customer.

Delivery will take place, according to the method chosen by the customer, within the delivery period communicated by CIL-LOU at the time of the order.

We do everything we can to package the goods as well and safely as possible. The delivery times are indicative. In the event of late delivery, no compensation can be claimed from CIL-LOU or the carrier. Delivery will take place within the legal term of 30 days. If it does not work within that period, the customer may dissolve the agreement free of charge, unless otherwise agreed and or communicated.

Shipping costs & collection points Belgium for consumers (B2C)

  • With an order above € 25 you enjoy free shipping, with delivery in Belgium! The shipping cost can be adjusted according to promotions.
  • For orders below this amount, you pay € 5.95 for delivery to your home or work.
  • If you want your package delivered to a collection point in Belgium, you pay € 4.95 for shipping.

Shipping costs Netherlands & Luxembourg for consumers (B2C)

  • With an order above € 50 you enjoy free shipping! The shipping cost can be adjusted according to promotions.
  • For orders below this amount, you pay € 6.95 for delivery to your home or work.

Shipping costs Belgium, the Netherlands & Luxembourg for B2B partners

  • For deliveries up to 15 kg, the shipping costs are €8
  • For deliveries between 15-30kg, the shipping costs are €15
  • For deliveries above 30 kg, the shipping costs are offered free of charge by Cil-Lou (this does not affect the minimum amount of € 150 excl. VAT for a first order, the weight of the products determines the shipping costs)

The weight of your B2B package is calculated based on the weights of our products, this weight is clearly stated in the shopping cart.

Control of the order


Upon receipt of the products, the customer checks whether the received product is in good condition.

In the event that one or more of the products ordered are missing or damaged, the customer or the recipient must formulate the necessary reservations to the carrier at the time of delivery and immediately inform CIL-LOU.

The verification is deemed to have been carried out as soon as the customer or his recipient accepts the order without reservation.

Any reservation not made in accordance with the rules defined above and within the time limits set cannot be taken into account and releases CIL-LOU from any liability towards the customer.

Error in the delivery


In the event of a delivery error or non-conformity of the products with the information on the order form, the customer shall inform CIL-LOU within 3 working days of the delivery date.

Any complaint not submitted within the deadline cannot be taken into account and releases CIL-LOU from any liability towards the customer.

Returns and Exchanges


The product to be exchanged or refunded must be returned to CIL-LOU in its entirety and in its original packaging.

The costs for the return shipment are the responsibility of the customer.

We make every effort to prevent, remedy and resolve any complaints.
We cannot be held liable for any injury or damage resulting from the use of our products.

Warranties

With regard to the delivery of goods, we apply the legal minimum guarantee period of two years, if the goods do not conform to the order placed. This means that in the event of defects or defects in the good, a free repair or replacement is possible up to two years after delivery.

Insofar as this is possible and reasonable, you have the choice between repair or replacement. Only in case the repair or replacement is excessive or impossible or cannot be carried out within a reasonable period of time, you have the right to demand a price reduction or the dissolution of the sales contract.

The lack of conformity must be reported to CIL-LOU as soon as possible and in any case no later than 2 months after the discovery of the sale.

Right of withdrawal


This article only applies insofar as the customer is a consumer. In that case, the customer can exercise his legal right of withdrawal and dissolve the agreement within 14 working days after delivery (: taking possession) of the products.

Return and Refund


If you are not completely satisfied, you can easily return the product. After notification of his decision to withdraw, the customer has 14 days to return the products.

The customer can request a refund of the returned product, without additional costs.

The costs of return are for the account of the customer.

The return or exchange of the product can only be accepted for the products if they are still complete, intact and in their original condition. If this is not the case, a reduction in value may be applied.

CIL-LOU will reimburse the customer for all amounts paid, including delivery costs, within 14 days of taking back the products.

CIL-LOU will refund the purchase price of the product paid by the buyer with the same payment method with which the customer paid himself, unless the customer agrees to another payment method.

Exceptions to the right of withdrawal


Any withdrawal that is not carried out in accordance with the rules and deadlines of this article and the applicable law cannot be taken into account and releases CIL-LOU from any liability towards the customer.

You cannot invoke the right of withdrawal if you have opened our sealed products and they cannot be returned for reasons of health protection or hygiene.

Data protection :

CIL-LOU will keep proof of the transaction, including the purchase order and the invoice, in its computer systems and under reasonable security conditions.

CIL-LOU guarantees its customer the protection of its personal data in accordance with CIL-LOU's privacy policy and GDPR legislation.

Force majeur


If CIL-LOU is wholly or partially prevented from executing the order due to an unforeseen circumstance beyond its control, this is a matter of force majeure.

In case of force majeure, CIL-LOU has the right to suspend the execution of the order in whole or in part for the duration of the force majeure. CIL-LOU will inform the customer immediately.
If the force majeure continues for more than 90 days without interruption, each of the parties has the right to terminate the contract unilaterally, by registered letter to the other party.

Applicable law and competent court


These general terms and conditions are governed by Belgian law.

In the event of a dispute and in the absence of an amicable solution, the dispute will be submitted to the court of the judicial district of the registered office of CIL-LOU.

Promotions and discount prices


Actions are announced on various channels. Promotions and discounts announced on social media and our webshop apply to B2C consumers. Promotions and discounts that are specific to B2B are clearly and timely indicated on the B2B account with additional information. B2B customers are personally notified of this via newsletter or our representatives.

The illegality or total or partial invalidity of any provision of these general terms and conditions shall not affect the validity and application of the other provisions.

Ownership right


No data or photos from our site may be copied or used without our express permission.

Retention of title


The delivered goods remain the property of CIL-LOU BV and this until full payment of the purchase price, including principal, interest and costs. The customer is prohibited from reselling, pledging or assigning the claim on the delivered goods before the purchase price has been paid in full.
